Правоохранительные органы России в обеспечении народовластия

Abstract

Исследуются теоретические подходы к определению форм непосредственной демократии в современной России, динамика их развития и правового закрепления. Автором выделяются императивная, регулятивная, консультативная и комплексная функции прямой демократии, на этом основании проводится классификация форм непосредственного народовластия. Проведен анализ законодательства, закрепляющего статус правоохранительных органов в сфере реализации механизма форм прямой демократии. Выделены используемые методы – негативного и позитивного регулирования с преобладанием последнего. Выявлены нормы, выполнение которых сопряжено со сложностями в силу отсутствия ясности и определенности. Автор приходит к выводу о том, что закрепляя статус правоохранительных органов в сфере прямой демократии, законодатель должен максимально четко формулировать их обязанности и механизмы их реализации. = The article examines the theoretical approaches to the definition of forms of direct democracy in Russia today, the dynamics of their development and legal binding. The author has highlighted the imperative, regulatory, advisory, and the complex functions of direct democracy on this basis, a classification of forms of direct democracy. From the perspective of the author, a leading role in implementing the constitutional foundations of democracy, the Russian state owns the mechanism of implementation of the forms of direct democracy. The analysis of legislation, enshrining the status of law enforcement agencies in the implementation mechanism forms of direct democracy is given. Identified the methods used - negative and positive control, with a predominance of the latter. Identified standards, implementation of which is associated with difficulties due to the lack of clarity and certainty. The author concludes that securing the status of law enforcement agencies in the area of direct democracy, as the legislator must clearly articulate their responsibilities and implementation mechanisms.
