"Уличные" обязанности сотрудников органов внутренних дел: от вопросов регламентации к проблемам реализации

Abstract

Рассматриваются проблемные аспекты реализации предписаний части второй ст. 23 «Обязанности сотрудников органов внутренних дел» Закона Республики Беларусь от 17 июля 2007 г. № 263-З «Об органах внутренних дел Республики Беларусь». Обращается внимание на то, что вопросы, не решенные при регламентации данной нормы, заложены в основе проблем, связанных с невозможностью обеспечения ее должной реализации. Предлагается новая редакция указанной нормы, устраняющая существующую правовую неопределенность на основе анализа использованных в статье формулировок. = The article discusses the problem aspects of the implementation of the second article. 23 “Obligations of employees of the internal affairs bodies” of the Law of the Republic of Belarus “On the Internal Affairs Bodies of the Republic of Belarus” (hereinafter – the Law on the Department of Internal Affairs) Attention is drawn to the issues that are unresolved in the regulation of this provision, are the basis of the problems associated with the inability to ensure its proper implementation. On the basis of the theoretical and legal analysis of the formulations used in the article, the author proposes a new edition of this rule, eliminating the existing legal uncertainty.
