Государственное принуждение в гражданском праве: совершенствование методологических подходов и нормативного закрепления в законодательстве Республики Беларусь

Abstract

Рассматриваются вопросы государственного принуждения в гражданском праве. Обосновывается совершенствование методологических подходов и нормативного закрепления в законодательстве Республики Беларусь. Предлагается новая редакция ст. 933 Гражданского кодекса Республики Беларусь. = The theoretical and legal design of state compulsion should be in demand by the science of civil law, taking into account the specifics of civil and legal regulation of public relations. This concerns the clarification of its place and the role in the system of the general legal design of coercion in civil law, the disclosure of the relationship between civil liability and other measures of state coercion that are not legal in nature by measures of legal responsibility, as well as the reasonableness of the implementation, in cases stipulated by law from guilt. In this regard, the rules governing the general provisions of civil liability require a normative fixing in a separate paragraph of Chapter 2 of the Civil Code of the Republic of Belarus. Article 933 of the Civil Code of the Republic of Belarus should be amended in the new wording, taking into account the tortious nature of the obligations due to the infliction of harm.
