Жалоба в государственном управлении

Abstract

Исследуются основные характеристики жалобы в государственном управлении, отражающие сущностные признаки последней в целях установления ее роли, места и назначения в сфере исполнительной власти. Рассматривается проблема определения понятия "сущность" и его смыслового наполнения в контексте проводимого исследования. Проанализировано соотношение охраняемых жалобой правовых категорий "права", "свободы" и "законные интересы граждан". Выявлены характерные элементы сущностного наполнения предмета жалобы, отражающие ее правовую природу = The main characteristics of the complaint in public administration are examined, reflecting the essential features of the latter in order to establish its role, place and destination in the field of executive power. The problem of determining the concept of essence and its semantic content in the context of the study is considered. The analysis and correlation of such legal categories protected by the complaint as the rights, freedoms and legitimate interests of citizens are carried out. The characteristic elements of the essential content of the subject of the complaint, reflecting its legal nature, have been identified.
