О совершенствовании административно-правового регулирования военизированной службы

Abstract

Рассматривается административно-правовое регулирование общественных отношений в сфере военизированной службы. Исследуется институализация военизированной службы, классификация нормативных правовых актов в зависимости от их юридической силы и функциональной роли в механизме административно-правового регулирования. Акцентируется внимание на анализе внутреннего единства видов военизированной службы, ее государственно-правовой сущности, правоохранительной направленности. Обосновывается необходимость разработки единых правовых основ и принципов ее осуществления. Аргументируются и выносятся предложения по совершенствованию административно-правового регулирования военизированной службы, выделению ее в совокупности с военной службой и государственной гражданской службой в подотрасль административного права, системно регулирующую общественные отношения в сфере государственной службы Республики Беларусь. = The article considers the administrative and legal regulation of public relations in the field of paramilitary service. The institutionalization of the paramilitary service, the classification of normative legal acts due to their legal strength and functional role in the mechanism of administrative regulation is investigated. A special role is given to the analysis of the internal unity of the types of paramilitary service, its state-legal essence, law enforcement orientation, which allows us to justify the development of unified legal foundations and principles for its implementation. Based on the analysis of the legislation, proposals are substantiated for improving the administrative and legal regulation of the paramilitary service, its separation together with the military service and the state civil service as a sub-branch of administrative law that systematically regulates public relations in the field of public service of the Republic of Belarus.
