Формула невменяемости: обзор современного законодательства

Abstract

Проведен сравнительно-правовой анализ современного законодательства стран постсоветского пространства и ряда государств дальнего зарубежья по заявленной теме. Установлены различия в законодательстве: в количественном составе критериев и (или) компонентов формулы невменяемости и в использовании различной терминологии для обозначения ее компонентов. Делается вывод, что использование двух компонентов (интеллектуальный и волевой) юридического критерия и одного компонента (психическое расстройство (заболевание)) медицинского критерия формулы невменяемости является оптимальным, поскольку придает данным критериям обобщающий характер и позволяет полностью охватить многообразие психических расстройств. = For the purpose of theoretical understanding of the problem of insanity, a comparative legal analysis of the current legislation of the post-Soviet countries and a number of foreign countries is carried out. The revealed differences in the legislation consist both in the quantitative composition of the criteria and (or) components of the insanity formula, and in the use of different terminology to designate its components. It is concluded that the use of two components (intellectual and volitional) of the legal criterion and one component (mental disorder (disease)) of the medical criterion of the insanity formula is optimal, since it gives these criteria a generalizing character and allows you to fully cover the variety of mental disorders.
