Система субъектов военизированной службы Республики Беларусь

Abstract

Проанализированы нормативные правовые акты Республики Беларусь, доктрина о военизированных организациях и их системе. Рассмотрены задачи, функции, элементы данной системы. Исследована правоохранительная функция как системообразующая связь элементов системы субъектов военизированной службы, органы государственной власти, оказывающие на нее управляющее воздействие. Предпринята попытка определения системы субъектов военизированной службы в широком и узком смыслах. Разработана классификация таких субъектов. Рассматривается проблема разграничения полномочий между управляющими системой военизированных организаций субъектами. Обосновывается вывод о недостаточной правовой регламентации механизма принятия совместных нормативных правовых актов. Предлагается внести изменения в законы, регламентирующие деятельность субъектов системы военизированной службы. = Analyzed the regulatory legal acts of the Republic of Belarus, the doctrine of paramilitary organizations and their system. Tasks, functions, elements of this system are considered. The law-enforcement function is investigated as a system-forming connection of the elements of the system of the subjects of the paramilitary service, the bodies of state power that exert a controlling influence on it. The definition of the system of subjects of the paramilitary service is proposed. Based on the functional principle, a classification of such subjects has been developed, the author’s definition of their system in broad and narrow senses is given. The problem of delimitation of powers between the subjects managing the system of paramilitary organizations is considered. The conclusion about insufficient legal regulation of the mechanism of adoption of joint normative legal acts is substantiated. It is proposed to amend the laws regulating the activities of the subjects of the paramilitary service system.
