Проблемы правового регулирования самостоятельной реализации права на защиту в административном процессе

Abstract

Делается обоснованный вывод о том, что при самостоятельной реализации права на защиту у физического лица отсутствуют правомочия, необходимые для полной и всесторонней реализации данного права. Предлагаются конкретные пути совершенствования административно-деликтного процессуального законодательства в целях устранения имеющегося правового пробела.=The article examines the problems of legal regulation of the exercise of the right to defense by an individual in relation to whom the administrative process is underway. The ways of realization of this right are analyzed. The competences of the said participant in the administrative process and the defense counsel are under consideration. A well- grounded conclusion is made that with the independent exercise of this right, the subject in question does not have the powers necessary for its full and comprehensive implementation. Concrete ways of improving the administrative-tort procedural legislation are proposed in order to eliminate this legal gap.
