Некоторые тенденции в развитии юридической науки и законодательства в 1917–1930-x гг. ХХ в.

Abstract

Автором сделан вывод о том, что нормы советского законодательства во многом повторяли положения дореволюционного права. Акцентируется внимание на том, что данная тенденция особенно была характерна в период кодификации советского права в 20-х г. ХХ в. = The features of the development of legal science and legislation in the 1971–1930s are considered. It is argued that in the Soviet legal doctrine, despite the change of the scientific paradigm, the conceptual and categorical apparatus developed in the pre-revolutionary period was actively used and a number of theoretical problems proposed by pre-revolutionary jurisprudence were developed. The author comes to the conclusion that the norms of the Soviet legislation largely repeated the provisions of the pre-revolutionary law. It is stressed that the given tendency was especially characteristic during the codification of the Soviet law in the 20s of the 20th century.
