Институт соучастия в преступлении в уголовном законодательстве России и Беларуси: сравнительное исследование

Abstract

Проводится сравнительный анализ уголовного законодательства Российской Федерации и Республики Беларусь. Акцентируется внимание на институте соучастия в преступлении обоих государств = Criminal law protection of public relations in the Russian Federation and the Republic of Belarus are similar in their legal nature, since they have common roots, the foundations of which were laid in the legislation of the Soviet period. The study and analysis of the institution of complicity in the Russian and Belarusian criminal legislation creates conditions for identifying positive aspects that can be taken into account by the legislator and law enforcement in order to choose the best ways to develop criminal policy. The specifics of the legal regulation of the institution of complicity in a crime in the criminal legislation of the Russian Federation and the Republic of Belarus can be divided into two groups. First, the authors include structural features – the features of the external expression of norms and provisions in the General part of the Criminal Code. The second group consists of the features of the content character – features related to the inner essence of the norms of the Criminal Code. Taking into account the considered specific features of the Belarusian criminal law, considered in this work, can be used by the Russian legislator in order to improve both the conceptual provisions of the Criminal Code, concerning, for example, the expansion of the grounds of criminal responsibility, and individual elements of the institution of complicity in a crime.
