Эволюция института наказания в уголовном праве

Abstract

Обосновывается необходимость оптимизации системы уголовных наказаний. Особо обращается внимание на обусловленность содержания санкций статей Особенной части уголовного закона видами наказания. Изучение основополагающих идей школ уголовного права позволило предположить, что существующая система наказаний является избыточной, а реальная оценка тяжести карательного воздействия некоторых видов наказания изменилась с течением времени = Based on the analysis of existing approaches in the legal literature, the necessity of optimization of the system of criminal penalties is substantiated. Special attention to the conditionality of the content of the criminal law sanctions of the types of punishments is paid. The study of the fundamental ideas of criminal law trends allows to make a suggestion that the existing system of punishments is excessive, the real assessment of the severity of the punitive impact of certain types of punishments has changed over time.
