Совершенствование правового регулирования процесса исправления

Abstract

Рассматривается проблема взаимосвязи психолого-педагогического содержания процесса исправления осужденных и правовых форм его реализации. Показан путь решения данной проблемы в учреждениях уголовно-исполнительной системы Республики Беларусь. Представлено авторское видение подходов к интеграции выработанных педагогической наукой (исправительной педагогикой) принципов, форм и методов в правовое поле исправительного процесса. Уточнены и конкретизированы компетенции субъектов исправительного процесса. Внесены конкретные предложения по изменению и дополнению норм Уголовноисполнительного кодекса Республики Беларусь = This article studies the problem of the relationship between the psycho-pedagogical content of the process of convicts’ correction and the legal forms of its implementation. The way of solving this problem in the institutions of the penitentiary system of the Republic of Belarus is shown. The author’s vision of approaches to the integration of principles, forms and methods developed by pedagogical science (Correctional pedagogics) into the legal field of the correctional process is presented. The competences of the subjects of the correctional process have been clarified and specified. Concrete proposals have been made to amend and supplement the norms of the Criminal Executive Code of the Republic of Belarus.
