О принципах в теории права

Abstract

Рассматриваются принципы как объект научного исследования в теории права и уголовно-процессуальной науке и исследуются для разработки теоретической модели уголовного судопроизводства, направленной на эффективное восстановление социальной справедливости. Анализируются сущность и роль принципов в правовой системе, включая их историческое развитие и разнообразие подходов к пониманию. Акцентируется внимание на влиянии принципов на формирование и практику применения в ходе досудебного производства. Выявляются ключевые проблемы в применении принципов, предлагаются пути их решения на теоретическом и практическом уровнях = The article considers principles as an object of scientieic research in the theory of law and criminal procedure science and investigates them for the development of a theoretical model of criminal proceedings aimed at effective restoration of social justice. The article analyzes the essence and role of principles in the legal system, including their historical development and diversity of approaches to understanding. Attention is focused on the ineluence of principles on the formation and practice of application in the course of pre-trial proceedings. The article identieies key problems in the application of principles and suggests ways to solve them at the theoretical and practical levels.
