Общественное мнение в системе уголовно-правового воздействия

Abstract

Проанализированы понятие, структура и роль общественного мнения в определении границ преступного. Акцентируется внимание на том, что общественное мнение является одним из атрибутов определения общественной опасности деяния, его социальной обусловленности, введения, изменения, отмены либо неприменения уголовно-правового запрета. Подчеркивается, что общественное мнение как маркер влияет на принятие законодательных и правоприменительных решений. Определяется, что, совпадая с мнением законодателя и лица, применяющего уголовный закон, общественное мнение способствует признанию совершенного деяния преступным и экономии уголовно-правового воздействия в отношении лиц, совершивших деяния, внешне обладающих признаками, предусмотренными Уголовным кодексом = In this article the concept, structure and role of public opinion in determining the boundaries of the criminality are analyzed. It is emphasized that public opinion is one of the attributes of determining the social danger of an act, as well as the social conditionality, introduction, modieication, cancellation or non-application of a criminal law prohibition. It is pointed that public opinion is a marker that ineluences the adoption of legislative and law enforcement decisions. It is determined that, coinciding with the opinion of the legislator and the person applying the criminal law, public opinion contributes to the recognition of the committed act as criminal and to the retrenchment of criminal law in relation to persons who committed acts that outwardly possess the characteristics provided for by the Criminal Code.
