Правовое регулирование концептуальных вопросов рабочего времени в трудовых кодексах государств – участников Содружества Независимых Государств

Abstract

На основе сравнительно-правового анализа трудовых кодексов государств – участников СНГ рассматриваются концептуальные вопросы рабочего времени: понятие и состав рабочего времени, порядок нормирования его продолжительности, виды рабочего времени, режим рабочего времени. Отмечаются как многие сходные черты, так и определенные различия в подходах законодателя независимых государств к правовому регулированию указанных вопросов. Констатируется, что в современных условиях рабочее время регламентируется более полно и содержательно в Трудовом кодексе Республики Беларусь. Формулируются конкретные предложения по совершенствованию норм Трудового кодекса Республики Беларусь и трудовых кодексов других государств – участников СНГ. = The article under consideration concerns the Labour Codes of CIS member states. The legal comparative analysis of the Labour Codes of the CIS member states has been laid down into the consideration of the working time conceptual issues such as, the notion and composition of the working time, the standardization order of its length, types of the working time and the working time regimen. It has been noted that there exist both many similar features and some definite distinctions in the applied principles to the legal regulation of the above mentioned issues by the legislators of the Independent States. It has been stated that the working time under contemporary conditions has been regulated more fully and profound in the Labour Code of the Republic of Belarus. Some concrete proposals on the perfection of the Labour Code rules both of the Republic of Belarus and other CIS member states have been formulated.
