Защита прав человека в России: конституционные основы

Abstract

Рассматриваются три вида конституционно закрепленных гарантий прав человека в России. Особое место уделяется истории и современности конституционного правосудия федерального и регионального уровня и его роли в системе гарантированности прав человека в России. Автор приходит к выводу о том, что проблема защиты прав человека и их гарантий состоит не в самой природе этих гарантий, а в возможности их эффективного использования, что напрямую связано с потребностями общества и активностью, правовой природой самого человека. = The article is dedicated to the characterization of three types of constitutionally vested guarantees of human rights in Russia. The special place is given to the history and modernity of constitutional justice in the federal and regional levels in the system of a warranty of human rights in Russia.These covers general state guarantees the rights and freedoms of man and citizen, the system of legal guarantees of rights and freedoms of man and citizen self-protection of human and civil rights and freedoms ‘by all means not prohibited by law’. A special place is given to history and modernity of constitutional justice within federal and regional level in its role in the safeguarding of human rights in Russia. The author concludes that the issue of human rights and guarantees is not in the nature of these guarantees and the ability to use them effectively, which is directly linked to society's needs and activity, the legal nature of man himself.
