Деформации правосознания личности: психологические аспекты

Abstract

Исследуется правовое сознание личности, рассматривается психологическая суть деформации правосознания. Выделяются и обосновываются психологические характеристики деформаций правосознания предкриминогенного, криминогенного и криминального типов. Характеризуются деформации правового сознания как совокупность психологических свойств, детерминирующих искаженное отражение правовой действительности, отрицательное отношение к правовым предписаниям, законности и правопорядку, а также асоциальную направленность поведения индивида или группы. Обосновывается, что предкриминогенные деформации правосознания характерны для индивида, склонного к законопослушному поведению, а криминогенные деформации, сочетая положительные и отрицательные представления о явлениях правовой действительности, выражаются в наличии отрицательных (противоправных) социально-правовых взглядов, убеждений и ожиданий. = The object of the study is the legal consciousness of the individual, and his subject is the deformation of the sense of justice. The result of the theoretical analysis is the isolation and justification of the psychological characteristics of the deformations of the sense of justice of the pre-criminogenic, criminogenic and criminal types. Deformations of legal consciousness are a combination of psychological properties that determine the distorted reflection of legal reality, a negative attitude to legal prescriptions, the rule of law and the rule of law, as well as the antisocial orientation of the behavior of an individual or group. The carrier of pre-criminogenic deformations of sense of justice is distinguished by the prevalence of the right-minded orientation of behavior. The carrier of criminogenic deformations of sense of justice combines positive and negative ideas about the phenomena of legal reality. Criminal deformations of sense of justice are expressed in the presence of negative social and legal views, beliefs and expectations.
