Ретроспективный анализ использования примечаний в уголовном законодательстве

Abstract

Рассматриваются актуальные вопросы использования примечаний в истории уголовного законодательства. Анализируются основные источники уголовного права. Обосновывается необходимость разработки классификации примечаний Уголовного кодекса Республики Беларусь. = Author describes actual questions of the use of remarks in the history of criminal law. The main sources of criminal law are analyzed. It is noted that today the remark remains one of the least studied methods of legal techniques used by the legislator in the process of construction of the criminal law. The author established backgrounds of remarks, described the main types of norms, existing in remarks, and stages of their formation. With increasing of differentiation of the criminal responsibility there is a tendency to detail norms of articles and their parts in the remarks. The necessity of development of the classification of remarks of the Criminal Law of the Republic of Belarus is described.
