Abstract

Проведен сравнительно-правовой анализ норм уголовного и уголовно-исполнительного законодательства о целях наказания и целях исполнения наказания. Приведена теоретическая модель эффективности наказания, как сложной и многоаспектной константы. Разъясняется значение эффективности исполнения наказания в ней. Исследованы проблемы целей наказания и целей исполнения наказания, закрепленных в действующих нормативных правовых актах, излагается необходимость внесения изменений в них с целью создания условий для рациональной оценки уровня эффективности наказания и эффективности исполнения наказания. = A comparative legal analysis of the provisions of criminal and penal legislation of the purposes of punishment and the purposes of execution of punishment is carried out. A theoretical model of the effectiveness of punishment as a complex and multi aspect constant is presented, and the importance of the effectiveness of the execution of punishment in it is stated. The problems of the purposes of punishment and the purposes of execution of punishment fixed in the existing normative legal acts are studied, the necessity to amend them in order to create conditions for a rational assessment of the level of effectiveness of punishment and the effectiveness of execution of punishment is stated.
