Сущность и методологическое значение принципов права

Abstract

Рассматриваются сущностные признаки принципов права и их значение в регулировании поведения человека и общества. Предлагается выделять принципы права в широком (мировоззренческом) и узком (формально-юридическом) значениях данного термина. Обосновывается наличие общей стратегической цели жизни людей. = Essential attributes of law and their value in regulation of human and social behaviour are considered in the article. It is suggested to determine attributes of law in wide (global) and narrow (formal legal) sense of this term. The existence of general strategic purpose of human life is grounded and, ideally, law and state should support the people to attain this general strategic life purpose. It follows that the main principle of law is reasonability, i. e. regulation of human behaviour from the point of maximally full application of his/her possibilities, creation of necessary terms for search, realization and attainment of the common strategic purpose of human life.
