Преступления против историко-культурного наследия в составе уголовного законодательства Республики Беларусь и стран СНГ

Abstract

Рассматриваются особенности уголовной ответственности за преступления, предметом посягательств в которых выступают историко-культурные (культурные) ценности. Анализируются признаки составов преступлений исходя из произошедших в 2013–2014 гг. изменений в уголовных кодексах стран СНГ. Выявлены мотивы совершения преступлений вследствие изучения судебно-следственной практики по делам данной категории. На основе сравнительного анализа уголовных кодексов стран СНГ сформулированы предложения по совершенствованию действующего законодательства в части усиления уголовно-правовой охраны историко-культурного наследия Беларуси. Приводятся практические примеры, свидетельствующие об актуальности данной проблемы. = The article considers the peculiarities of criminal liability for crimes subject to claims which are of historical and cultural (cultural values) values. Analyzed the signs of crimes, taking into consideration 2013-2014 changes in the criminal codes of the CIS countries. Based on the study of judiciary practice on the cases of this category, identified the motives of the crime. Comparative analysis of the criminal codes of the CIS countries allowed to formulate proposals to improve the current legislation in the part of strengthening the legal protection of historical and cultural heritage of Belarus. Practical examples ave given to demonstrate the relevance of this problem. Work is addressed to specialists in the field of protection of historical and cultural heritage. Article conclusions and recommendations may be useful to legislative organs, used in law enforcement bodies of internal affairs.
