Проблемы нормотворческой техники (примечания главы 35 Уголовного кодекса Республики Беларусь)

Abstract

Рассматриваются проблемы нормотворческой техники примечаний, расположенных в гл. 35 Уголовного кодекса Республики Беларусь «Преступления против интересов службы». Отмечается, что в большинстве случаев примечания Особенной части дополняют либо детализируют отдельные нормы и институты Общей части. На основании анализа формы и содержания примечаний, расположенных в уголовном законе, сформулированы требования к их расположению, структуре и последовательности изложения, а также порядку разъяснения терминов. = The article discusses the problems of legislative technology that are characteristic of the notes located in Chapter 35 of the Criminal Code of the Republic of Belarus “Crimes against the interests of the service”. The relationship of the notes in the Special Part of the Criminal Law with the norms and institutions of the General Part is noted. Based on the analysis of the notes located in the Criminal Code, requirements are formulated for their location, structure and sequence of presentation, as well as the procedure for explaining the terms.
