О соотношении морали и права в правовом государстве

Abstract

Акцентируется внимание на проблеме соотношения морали и права в государстве, вопросах духовного кризиса и снижения уровня морали. Рассматривается юридический механизм формирования наименее социально приемлемого вида правомерного поведения. Обосновывается необходимость корректировки психологического и социального механизма формирования поведения людей с учетом государственной идеологии. = The author lays special emphasis on the problem of correlation between morality and law in a state. Spiritual crisis stated by the majority is also reflected in reduction of the moral standard. In a contemporary society the number of normative legal documents is constantly growing which is seeking to normalize relations between people, the field where moral rules have previously functioned. However, the legal mechanism of behavior shaping can form the most primitive and less socially acceptable kind of good behavior when a person observes to the legal demands under the threat of measures of state compulsion or as a result of their application. Regarding to the above mentioned it is suggested to give more consideration to psychological and social mechanisms of behavior shaping but not to the legal one. Special attention should be paid to the state ideology.
